 (请相互尊重,切勿抄袭)《*人民共H国海关暂时进出境货物管理办法》日前正式施行。在执行中，海关发现《办法》虽然列明了暂时进出境货物的范围，但在实际进出口活动中，货物情况比较复杂，有时会出现张冠李戴的现象。

一、关于核准下列几类物品暂时进出境时，不在《办法》规定的暂时进出境货物范围之内：

被测试的货物和物品，但用于测试的样品除外；直接用于生产的货物，但对临时进口（期限在半年以内）的加工贸易生产所需不作价设备（限模具、单台设备），按暂时进口货物处理，逾期补征税款；进行加工的货物和物品。

本办法规定暂时进境货物应当复运出境，如果暂时进口的货物终出口到第三方而非返回原发货人，则不属复运出境的范畴。

These Measures provide that goods temporarily imported shall be re-shipped out of the country. If goods temporarily imported are eventually exported to a third party instead of returning to the original consignor, they shall not be re-shipped out of the country.

二、关于期限：暂时进出境货物应当在进出境之日起6个月内复运出境或复运进境。因特殊情况需要延长期限的，ATA单证册持证人、非ATA单证册项下暂时进出境货物收发货人应当向主管地海关提出延期申请，经直属海关批准后，可以延期，但延期多不得**过3次，每次延长期限不得**过6个月。延长期届满，货物应当复运出境、进境或者办理进出口手续。

三、About the time limit: the goods temporarily entering or leaving the territory shall be transported out or into the territory within 6 months from the date of entering or leaving the territory. If the extension of the time limit is required by special circumstances, the ATA carnet holder or the consignee or consignor of goods temporarily entering or leaving the territory under the ATA carnet shall apply to the customs in charge for extension, which may be extended after approval by the customs directly under the ATA carnet, but the extension shall not exceed three times and each extension shall not exceed six months. At the expiration of the extended period, the goods shall be transported out of or into the country again, or the import and export formalities shall be completed.

暂时进出境货物申请延长复运出境、进境期限的，以及已进/出境的“暂时进出口货物”不再复运出/进境的，暂时进出口货物收发货人应当在原批准暂准进境期限届满30日前向原进出境现场海关申请。

三、关于报关单填制：已进境或出境的暂时进出口货物不再复运出境或进境的，经海关审批同意后，货物收发货人应当按照规定重新填写报关单，向海关办理正式进口或出口手续，报关单关联报关单栏内应注明原暂时进境或出境的报关单编号，涉及许可证件的应按照规定补办。

暂时进出境货物未在规定期限内复运出境或者复运进境，且纳税义务人未在规定期限届满前向海关申报办理进出口及纳税手续的，海关应责成暂时进出境货物收发货人按照规定缴纳税款和滞纳金，并在原申报的报关单上进行相应内容的修改。

四、关于征税：暂时进出境货物并非都可暂时免征关税。虽然《关税条例》*四十二条款中所列的暂时进出境货物，在海关规定期限内复运出境或复运进境时可以暂不缴纳税款，但对该条款所列范围以外的其他暂时进出境货物，海关都会按照审定进出口货物完税价格的有关规定，以及海关接受该货物申报进出境之日适用的计征汇率、税率，审核确定其完税价格，按月征收税款，或是在规定期限内货物复运出境或进境时征收税款。

五、关于商品检验：《*人民共H国进出口商品检验法实施条例》规定，暂时进出境货物属于免于检验的商品，其中不涉及动植物检疫的，在办理暂时进出口手续时*提交《入/出境货物通关单》。

About commodity inspection: According to the Regulations for the Implementation of the Law of the People's Republic of China on Import and Export Commodity Inspection, temporary import and export goods belong to commodities exempted from inspection, and those that do not involve animal and plant quarantine are not required to submit the Customs Clearance Form of Import and Export Goods when going through temporary import and export formalities.

六、关于限制：暂时进境汽车不受国家汽车产业政策关于整车进口*口岸的限制；暂时进境汽车允许转关监管，直至运抵海关办理暂时进境手续；经海关同意在境内留购的暂时进境汽车，必须转关至整车进口*口岸办理进口手续。

作为货样暂时进境的车辆，自进境之日起6个月内必须复运出境，不得留购，不得延期。测试用车辆及其零配件不论是否损毁，期满必须复运出境。

禁止进口二手（旧）汽车、右舵车。其中经审核符合暂时进出境货物管理办法并能提交国家主管部门相关证明等文件的，可以办理暂时进境手续，但期满必须复运出境。

七、关于担保：经海关批准的暂时进出境货物，在货物收发货人向海关缴纳相当于税款的保证金或海关依法认可的其他担保后，准予暂时免纳关税。对不征收进出口关税的暂时进出境货物，可凭货物收发货人或其代理人提交的保证函验放。
